  EBA participated in the Reforms Council

On the 25th of August 2010 the President of the EBA Board Trond Moe, Telenor and the Executive Director of the EBA Anna Derevyanko participated in the Reforms Council meeting which was dedicated to launching of the National Projects. President Yanukovych chaired the meeting, and Mykola Azarov, Sergiy Tigipko, Boris Kolesnikov and all the other top government ministers participated.

Anna Derevyanko was invited to deliver a speech, at the meeting. Ms. Derevyanko suggested that the criteria of the projects should be build on the basis of transparency. She, also, emphasised the necessity of Ukraine’s development as Successful Business Destination. The EBA is ready to maintain constructive cooperation with the government on these issues.

President Yanukovych launched 10 national projects that the government and the President will personally follow up and promote. Some of those projects are big and visionary, like Winter Olympics in the Carpathians in 2022 and transforming Kyiv to a pilot “city of the future”.
  But there were also concrete projects, like building an express railway to Borispol Airport and constructing an LNG terminal by the Black Sea. The projects were presented by Mr. Kaskiv, who has been appointed by the President for this task.


Here is the full list of projects, grouped in four:

1. NEW ENERGY
- LNG terminal - Sea port for receiving liquefied gas;
- Energy of the nature: Building wind and sun electricity generating plants.

2. NEW QUALITY OF LIFE
- Affordable housing: Social support of the population;
- Clean city: Modern ways of recycling waste materials;
- Clean water: Providing the society with clean water;
- Open society: Creating information, communication and educational networks on a national level (incl. 4G);
- The city of the future: Creating strategic plans for city development (using Kyiv as a pilot city);
- New life: New ways of parenthood and childhood.

3. NEW INFRASTRUCTURE
- Air Express Express: passenger train to Borispol Airport and completion of the new terminals.

4. OLYMPIC HOPE 2022
Project: Construction of sports and tourist facilities.

A new state agency will be created to implement these national projects.

  New UK Bribery Law will affect business in Ukraine

New anti-bribery legislation to be introduced in the UK has far-reaching implications for both UK based multi-national companies and companies wishing to trade in the UK. The website of the UK’s Ministry of Justice identifies bribery as a “serious crime which destroys the integrity, accountability and honesty that underpins ethical standards in public life and in the business community”. With this in mind, new Anti Bribery legislation is being introduced in the UK that takes aim at corruption both in the UK and abroad.

Like the tough Foreign Corrupt Practices Act (FCPA) in the United States, the UK Anti-Bribery Act has international jurisdiction making British companies liable for acts of bribery regardless of where the crime is committed. In short, this means that CEO’s and business leaders in the UK and America risk prosecution at home if they fail to take adequate measures to prevent corruption within their company abroad. To understand the implications of the new Law, the EBA put the following questions to the British Embassy in Ukraine:


Could you summarise the main objective of the new Law?
The Bribery Act 2010 (the Act) received Royal Assent on 8 April 2010. The purpose of the Act is to reform the criminal law of bribery to provide for a modern, comprehensive scheme of bribery offences to cover bribery both in the United Kingdom and abroad. The Act will replace the fragmented and complex offences contained in common law under the Prevention of Corruption Acts 1889-1916. The Act will reinforce the UK’s reputation as one of the least corrupt countries in the world.

When is the law likely to take effect?
The UK government announced on 20 July 2010 that the Act will enter into force in April 2011. The exact date will be announced by the Secretary of State.

Who does the law affect and what implications does this have for British and non-British companies in Ukraine?
The Act affects all companies incorporated in the United Kingdom. All foreign companies that do business in the United Kingdom (wherever they are incorporated) are also affected by the Act. This is in part due to the new provisions in the Act requiring commercial organisations to have adequate procedures in place to prevent bribery. British and non-British companies (undertaking commercial business in the United Kingdom) operating in Ukraine will have to be able to demonstrate that they have adequate procedures in place to prevent bribery which meet the requirements of the Act. Under the provisions of the Act, the Secretary of State is required to publish guidance about the type of procedures companies can put in place to prevent bribery. In September, the Government will launch a short consultation round on the guidance procedures which will be published early next year to allow businesses adequate preparation time before the Act enters into force.

What obligations does the new Law place on the UK Embassy in Ukraine?
The Act does not impose any specific legal obligations on the British Embassy in Ukraine. However, the Embassy is open to providing advice and guidance to UK companies and answering factual queries. We are, at the same time, keen to raise awareness of the new Act. In addition, all members of staff working at the Embassy who become aware of, or receive information relating to, acts of bribery committed by UK nationals, UK companies, their subsidiaries, representatives or agents, or other incorporated bodies and required to report the details to the United Kingdom Serious Fraud Office.
  How is the Embassy promoting awareness of the new Law?
We will publish guidance on the main provisions of the Act on our website with links to additional sources of advice and guidance. In doing so, our aim is to help companies prepare for the new legislation by clarifying the current situation, noting the key changes under the new Act and encouraging them to look at their internal procedures to ensure they comply with the legislation. The Embassy will continue to participate in events, such as the EBA’s recent discussion forum, to highlight the new legislation.

Where can companies find additional information and support materials with details of the Law?
There is a wealth of guidance available to UK and international companies on bribery law and managing the risks of overseas corruption, including international best practice and practical tools. In the UK, the Department for Business, Innovation and Skills co-ordinates advice for UK businesses. Information is available on their website. Another key resource is the UK-sponsored Business Anti-Corruption Portal which contains a variety of instruments and information which can be used alone or in combination with other information sources, including familiar and well-known procedures and methods adapted to small and medium sized enterprises. There are also newer tools available, for example there is a practical new anti-corruption training tool for companies, known as RESIST, for companies facing bribe solicitation or extortion - further details can be found here.

What advice are you giving UK companies regarding this new Law?
Is it something they need to take action on or should they just be aware of the act? We are able to provide UK companies with advice on the main provisions of the Act and where and how they can find out more about its implications. However, we cannot give companies legal advice or assistance, or advice on their internal policies and procedures.

Are there any corresponding EU initiatives or laws in this area?
The European Union has a range of initiatives within a general framework aimed at fighting corruption including conventions against corruption involving officials and combating corruption in the private sector (see). EU member states are bound by these conventions and their own national anti-corruption legislation. Other international organisations, such as the UN and OECD, have a variety of international conventions and instruments in place regarding the fight against corruption.

Is there a risk that, with the introduction of such a law, UK and international companies will become more insular choosing only to award contracts to themselves rather than smaller Ukrainian suppliers?
According to the OECD, corruption threatens good governance, sustainable development, democratic process and fair business practices. The introduction of new legislation in the UK which consolidates and modernises previous legislation, and which meets international standards, will enhance the openness and transparency of UK companies and international companies operating in the UK. It is not, however, for the Embassy to speculate on how companies might react to the introduction of the legislation in terms of their external business practices.

During the EBA presentation this week we discussed the possible introduction of an EBA ‘ethical business’ award or symbol that companies could apply for. What do you think of such a scheme and how might the UK Embassy support such an initiative?
The British Embassy in Ukraine regularly raises, both bilaterally and multilaterally, issues relating to the business and investment climate, including the fight against corruption, with government representatives, business contacts and other partners. In principle, the Embassy is interested in worthwhile initiatives aimed at improving the investment climate. We would certainly like to hear more about the proposed EBA scheme, what it aims to achieve and how it might operate.

  After short summer break the EBA is glad to revive it’s educational activities with a new series of EBA master-classes organised in conjunction with D&Y training company and Andreas Weinzierl.

The Image Style and Etiquette Master-Classes will teach attendees about the different components which form image and dress codes and offer guidance on rules of style and etiquette.

As we know, first impressions are extremely important and we hope that the courses will be a great benefit to men and women who regularly meet, host and do business with European colleagues and clients. The courses are open to all EBA members.

EBA EuroDrink Party – British Night
 

  In conjunction with the British Embassy, the EBA hosted another fantastic EuroDrinks event on 27 July at the residence of the British Ambassador.

With drinks and food available outside on the lawn, guests were treated to live music and a wonderful view across the region. Event sponsors provided a number of gifts and prizes for the business-card lottery with guests winning dictionaries, shopping vouchers and weekend breaks.

Appropriately for a British night, the rain threatened to pour but, thankfully it held-off until the evening was over allowing for a fun and enjoyable event. The EBA extends its thanks to the British Embassy and its

  Government approved the main prognostic macroindicators of economic and social development of Ukraine for 2011 year

The main prognostic macroindicators of economic and social development of Ukraine for 2011 year were approved with the Resolution of Cabinet of Ministers of Ukraine on Approval of the Main Prognostic Macroindicators of Economic and Social Development of Ukraine for 2011 year No 701 dated 11 August 2010.
  The statements of the Resolution envisage the GDP growth at the level of 4,5%, nominal GDP will amount 1 trillion 253 billion UAH. The consumer price index will amount 108,9%, producer price index – 111,3%. Also according to the adopted prognostic indications the average nominal salary will amount 2587 UAH, balance of trade calculated according to the balance of payment methodology will be negative in 2011 year in amount of 2,479 billion of USD, good and services export will amount 72,908 USD, import - 75,387 USD.
