EBA meets with Vice Prime Minister Serhiy Tihipko |

On Thursday 11 March, Serhiy Tihipko was appointed as Vice Prime Minister of the new parliamentary coalition formed between the Party of Regions, the Lytvyn Bloc, the Communist party and some individual MPs. Shortly after his appointment on Thursday, Serhiy Tihipko took the initiative to call the EBA and request a meeting on Friday – just a day after being appointed.
In doing so, he demonstrated a real willingness to cooperate and to consider the views of the business community and we are pleased to say that this was reflected in the meeting itself.
A number of issues were discussed and the EBA was asked to provide information in support of its proposals for the improvement of the business environment in Ukraine.
These have been forwarded to Mr Tihipko and the EBA are in the process of elaborating on these ideas and working towards their implementation. |

What will happen i 2010? EBA Board Member, Maarten Durville discusses his outlook for the year ahead.
Name: Maarten Durville
Nationality: Dutch
Vocation: General Maneger, Philips Ukraine LLC, EBA Board Member
Background: Maarten Durville is from the Netherlands and started work in Ukraine in May 2008, a few months before the crisis hit. In his 15 years for Philips he has lived and worked in different, mostly commercial roles in the Netherlands, Germany and Taiwan.
1. What is the most alarming trend facing the Ukrainian economy today?
I think it is the question of whether or not the government can get the budget under control. If not, that would be alarming for the country as a whole and it would be detrimental for the business climate. To manage the economy costs need to be cut. This was extremely difficult in the pre-election climate but now it must be addressed. It provides tough choices for any government, not just Ukraine, but these choices must be made. Increasing revenues and doing it sensibly is the other important issue. If it isn’t done well, it will only drag on longer and the whole population will feel the effects – the government budget is an important one.
2. What will be the biggest Ukrainian success in 2010?
I think the biggest success would be to balance the government budget but without incurring too much of a social cost, to limit the impact on those people that already have little. It’s easy to say that pensions cost too much however; behind these figures are all the pensioners who have worked their entire lives and now have to live on a small amount each month. So to balance the budget whilst keeping the social cost to a minimum would be the biggest success, it’s not easy.
3. What direction will the Ukrainian stock market move and what kinds of returns (if any) do you predict?
I don’t follow the stock-market. My guess is that it will go up a little but I really don’t know.
4. What should be the first priority for the new Ukrainian President?
We have at the EBA outlined seven focal points. As individual companies we don’t all suffer from the same seven problems however for the business community at large I think those seven priorities are clear. Furthermore I think it’s important to explain why. It is not necessary so that Ukrainian or foreign multi-nationals can simply make more money; it is required to make Ukraine attractive to foreign investment. At this moment Ukraine has everything – an attractive location, relatively low cost, well educated people and a large population both in terms of the labor market and as consumers but still a lot of companies hesitate to invest. Why? Because of the judicial system, corruption… if you export and don’t get your VAT back then you’re not going to invest here. However, Ukraine needs foreign direct investment to create jobs and prosper. It is good for the people of Ukraine and it is good for the economy as a whole (good for Ukraine) and it’s not just for the bottom line of a company such as Phillips. So, I fully support the seven EBA priorities. More FDI will bring more prosperity, more jobs, and more opportunities. Everything is here but it’s very difficult to do business here.
5. Which business sector will be the 'rising star' in 2010?
My guess is construction because it was hit so hard by the crisis. If you go down 80% it’s easier to go up by |

10%. …and my wish is healthcare. Phillips is active in the healthcare market, so I have first hand knowledge that it needs a lot of basic improvements. Basic care and hospitals are in dire need of improvement and so I wish it would be the healthcare sector and that it will get the investment it needs to raise the level of healthcare across Ukraine.
6. Which emerging world economy is the best bet for investors?
I think China. They have adequate financial resources and a dedicated government. They understand that they have to take care of their people and of their businesses and they consciously try to make the most out of what they have. It’s something I respect a lot and I think China will continue to be the rising star of world economies.
7. What will be the 'must have' item in Ukraine in 2010?
A 21:9 TV It’s new, it’s fantastic and it’s definitely the must have item - you no longer have to go out to go to the cinema! Maybe it’s not affordable for everyone yet but - It’s the must-have gadget.
8. What is the best Ukrainian asset to own in 2010?
I would like to say land but it’s still impossible, though is one of the greatest assets Ukraine has. Maybe gas, gas is the best-kept secret in Ukraine. The best assets that Ukraine has are its land and its people. They are an unbeatable combination.
9. Global warming: fact or fiction? How much money and effort should the Ukrainian invest in emissions cuts?
Fact, and even if somebody believes otherwise there are only good reasons for saving the limited resources we have. You have you use the little things you have sparingly – they are not infinite. Also, many of the investments make sound economic sense. It’s very easy to calculate the payback time of an investment to switch to energy efficient lighting for example and it does not take long to earn back your investment. We regularly conduct energy audits for companies and can provide them significant savings. Very often, what makes sense environmentally makes sense for the economy as well.
10. Will Ukraine be ready for the 2012 Football Championships?
I think it will be ready in a Ukrainian way. The Germans and the Dutch would do it perhaps differently – they would like to be ready two or three years in advance with everything checked but this is Ukraine, not Germany not Holland. Yes the games will be held here, at least in three cities if not four. And yes tents will be pitched for the fans, but I think fans will be happy to sleep in a tent as long as they can see the games.
11. What will be the biggest surprise of 2010 in Ukraine?
The biggest surprise would be if Yanukovych and Tymoshenko shake hands, bury their differences and do what’s best for the country – that would be the biggest surprise What I would like is; if they could agreed to disagree on a numbers of items but work together on the things that they both agree on such as the economy, corruption etc I’ve set myself the following test. For some reason, not known to or understood by me, a small sheet of paper (a form) must be completed every time you visit another city on business. It must be signed and returned to the authorities. There must be whole warehouses of these completed forms in Kiev. Nobody is making a good case for the forms, nobody is explaining why they are needed or what purpose the serve and so, as long as they exist, I believe things are not changing. When this document is abolished – Ukraine is really changing. |

EBA INVESTMENT Business Morning

The EBA hosted an INVESTMENT 'Business Morning' meeting for the benefit of its member companies. The meeting featured presentations from representatives of the European Investment Bank (EIB) and the Global Emerging Markets (GEM) investment fund. Talking to a packed audience, they presented their investment and financing opportunities for businesses in Ukraine.
The EIB European Union’s long-term lending bank set up in 1958 by the Treaty of Rome and is owned by the 27 Member States of the European Union. The EIB contributes to the realisation of investment projects that further the economic, social and political cooperation priorities of the EU and is therefore of significant interest to EU/Ukrainian companies operating in Ukraine.

The GEM Group however; targets Small/Mid Cap Private and Listed Companies and Mr Glauco presented the company and their products to the attending guests. |

Representing the organisations were:
- Philippe Szymczak: Head of the Eastern Europe, Southern Caucasus and Russia - Transport and Telecommunication Division, within the Europe's Neighbour and Partner Countries Department, the European Investment Bank.
- Tore Emanuelsson: Head of the EIB Representation Office in Ukraine, Eastern Europe, Russia, Southern Caucasus & Central Asia Division, Europe's Neighbour and Partner Countries Department, the European Investment Bank.
- Mr Glauco C. Verdoia: Partner, GEM Global Emerging Markets.

The meeting took place in the new EBA conference hall (located under the existing office on Andriyvsky Uzviz) and we were happy to welcome such a large and interested crowd of participants.

Concert "Barbara avec passion"

The EBA was delighted to host a sell-out performance of "Barbara avec passion" by Isabelle Vajra at the Kyiv Philharmonie on Saturday evening. Isabelle ecieved a warm welcome before performing a moving and autobiographical series of songs for the guests and dignitaries. |
|
Guests enjoyed a formal reception after the event that provided the perfect opportunity to relax and reflect on the performance.
The event had been organised in partnership with President foods, Repriza cafe and the French-speaking embassies in Kyiv as part of the Francophonie celebrations. The EBA is truly grateful to all attended and to everyone who helped make the event such a success.

EBA Life Insurance Committee
During this meeting the EBA Life Insurance Committee members had an opportunity to discuss the number of issues with representatives of the State Commission on Financial Services Markets (DFP) Mrs Halyna Tretiakova and Mrs Kira Grozava.
Mrs Tretiakova and Mrs Grozava informed the EBA Life Insurance Committee members on the functioning of the DFP after its restructuring and responsibilities of different units. The parties also discussed questions regarding the qualification requirements of the actuaries. The representatives of DFP expressed the desire in further cooperation with the EBA Life Insurance Committee on various issues.

EBA Health Care Committee Registration Subcommittee
At the beginning of the meeting, participants were updated on the latest legislative initiatives and letters of the HCC. In this regard, presents dwelt on status of the Braille font implementation and respective Draft Law of Ukraine on Amendments to the Article 12 |

of the Law of Ukraine Medical Drugs.
During the meeting main attention of participants was drawn to the discussion of the newly adopted CMU Resolution on Amendments to the CMU Resolution on Quality Control of the Medical Drugs Imported in Ukraine No 902 dated 14.09.2005.
The main part of the meeting was dedicated to the discussion of the regulatory acts, which are now under the public discussion. Among these, Draft Concept of reforming and development of the system of Medical Drugs Quality Control in Ukraine, Draft CMU Resolution on the Approval of the Procedure of Conduction of Manufacturing Sites Certification and Draft CMU Resolution on the Procedure of the Ban, Stoppage and Withdrawal of Medical Drugs from Circulation were analysed. As a result of the meeting, a set of comments and remarks were developed and agreed by the Subcommittee.
Also, the guests of the meeting were informed about the Order of the State Customs Service of Ukraine on Establishment of Customs Check-Point and Amendments to Certain Orders of the State Customs Service of Ukraine No 130. |

All these buildings were built for world exhibitions. In 2010, the World Expo will be held in Shanghai (China), and the Chinese government will try to exceed all previous Expo’s, investing over 3 Billion Euros in the construction of new Expocity with total area of 5.28 square. km in the center of Shanghai.

The EU expects President Yanukovych not to sign the recently adopted public procurement law
The European Union expects Ukrainian President Yanukovych to veto the respective law. After carefully studying it, EU experts came to the conclusion that this law, adopted by Verkhovna Rada on 11 February 2010, is not fully in line with European standards. These concerns were communicated, jointly with the World Bank, to the Presidential Administration. Main concerns not in line with EU standards raised by EU experts are:
• the adopted scheme of the appeals review mechanism does not meet key EU requirements of the impartiality and independence - this leads to corruption;
• excessively burdensome procurement procedures and too many sectors escape the application of the law - this undermines the transparency

Visit of HR/VP Ashton to the Middle East (14-18 March 2010)
Catherine Ashton, High Representative of the Union for Foreign Affairs and Security Policy and Vice President of the Commission will visit Egypt, Syria, Lebanon, Jordan, Israel and the Palestinian Territories from 14 to 18 March 2010. In the region Ms Ashton will meet with political leaders, civil society representatives, hold a key note speech in Egypt and meet with representatives of the EUBAM Rafah and the EUPOL COPPS Missions. Prior to her visit, High Representative Ashton said: "The Middle East is a major foreign policy priority for the EU and I am pleased that I can visit the region so early on in my tenure. I will visit Egypt, Syria, Lebanon, Jordan, Israel and the Palestinian territories. After my visit, I will participate in Moscow at the Quartet Meeting."

The Mansion House Scholarship Scheme in Ukraine: Opportunity to go on a business attachment to the City of London
During his visit to Kyiv in September 2009, Alderman Ian Luder – the then Lord Mayor of the City of London, announced the award of a Mansion House Scholarship in Ukraine. The British Embassy in Ukraine is therefore pleased to announce the start of the application process to identify the successful winning candidate to attend a short business attachment in the City of London. |

The Mansion House Scholarship Scheme exists to fund students or young business executives from overseas to travel to the United Kingdom to study or to undertake training or work experience in the Financial Services Sector. The Scheme was established by a previous Lord Mayor of the City of London in 1997/98. The aim of the Mansion House Scholarship Scheme is to attract the brightest and best from the financial services sector or Government Ministries in countries which have strong links with the UK financial services sector and in particular with the City of London, with a view to long term benefit to both sides.

Small businesses are urged: “Aim for more than just survival in 2010” - ACCA research lifts the lid on finance professionals’ advice to small businesses
Most finance professionals believe that survival can no longer be the only objective for small businesses, according to new research by ACCA (Association of Chartered Certified Accountants). Significant M&A transaction in Ukraine

ILF courts victory for a big bank in the long-running UAH 29 mln debt collection lawsuit
ILF attorneys have secured a court victory for a big bank which will receive UAH 29 mln as a debt recovery. The litigation turned out to be long-running and complicated since the debtor tried to annul the loan agreements and agency contracts, disputing and delaying proceedings in the case. Consequently, besides the main case, the firm’s advisors handled three more cases on invalidation and termination of the agreements. ILF team representing the bank’s interests in the court was led by partner Oleksiy Kharytonov and included attorneys Olena Khytrova, Anna Gebeleva, and Dmytro Lazebny.
